The Government of India has issued a notification through which it restricted the handling of hazardous waste containing the rare metals like PGMs. Before the notification, handling these hazardous waste was free of cost. But now, anyone who wants to handle the procedure should apply for a license and then only the person will be eligible for the task. Now if someone wants to import any hazardous waste containing rare metals they should seek permission from the Directorate General of Foreign Trade or DGFT.
The waste materials we are talking here about are found mostly in the form of ash. The Ash is filled with rare metals like Platinum, Gold, Silver, etc. It is therefore important to have the set of expert hands to extract all those rare metals from the hazardous waste ash.
The Directorate general of Foreign Trade has issued a notification on 29th April 2022. Through this notification, they have labeled the rare metals available in the Catalytic Converter and Milled Ceramic Waste as Restricted for export. If anyone wants to export these rare metals cladded in ash from India to any other country, the person or agency needs to have a proper license for completing the task.
List of items termed as ‘Restricted’ from being ‘Free’
This list contains the items that were used to be the free ones and now are termed as restricted due to the notification from the DGFT.
- Scraps like ash and other products from Catalytic Converter and Milled Ceramic Waste that contain rare metal compounds in any nature.
- Clad metal with Platinum excluding other swept materials.
- Clad metal with Gold excluding other swept materials.
- Clad metal with Silver excluding other swept materials.
- Swept wastes that contain Platinum
- Swept wastes that contain Gold
- Swept wastes that contain Silver
- Swept wastes that contain other rare and pricey metals.
Requirements of the agency for export authorization
The Ministry of Environment and Forest, or MoEF is the governing body that allows licenses for the companies that want to export Crushed Milled Ceramic and Catalytic Converter waste. Without this official permission certificate the companies are not permitted to export the hazardous waste from India to anywhere in the world.
Individuals and agencies that want to get the license for exporting the scraps from Crushed Milled Ceramic and Catalytic Converter waste to other countries must apply for the same in a prescribed format.
The agency should maintain the following requirements:

- The agency should be prepared for cleaning the scraps of Crushed Milled Ceramic and Catalytic Converter waste in case of any type of spillage during the exportation of the same.
Important documents for exportation of Crushed Milled Ceramic and Catalytic Converter waste
The following documents are necessary for an agency or an individual to gain the exportation license for Crushed Milled Ceramic and Catalytic Converter Waste from India to any other country.
- Authorization certificate from State Pollution Control Board to handle and export any hazardous waste or scrap like Crushed Milled Ceramic and Catalytic Converter Waste.
- Authorization certificate from Ministry of Environment and Forest to handle and export any hazardous waste or scrap like Crushed Milled Ceramic and Catalytic Converter Waste.
- Authorization certificate from Directorate General of Foreign Trade.
- Authorization certificate and permission letter from the country where the hazardous waste and scrap being exported, assuring they do not have any problem with the exportation.
- Insurance papers that cover the whole exportation procedure.
- An agreement between the countries that take part in export and import of the hazardous waste such as Crushed Milled Ceramic and Catalytic Converter Waste.
Procedure for export authorization of Crushed Milled Ceramic and Catalytic Converter waste
This is the procedure for export authorization of Crushed Milled Ceramic and Catalytic Converter Waste.
- The agency or individual eyeing to grab the authorization for export of Crushed Milled Ceramic and Catalytic Converter waste must fill a form online or offline. The form is available in both the modes, the applicant may choose one as per his convenience.
- Once the applicant fills in the form and submits it to the State Pollution Control Board, they will send an acknowledgment in return. It is the proof that the applicant has successfully submitted the application.
- The Ministry of Environment and Forest will issue a public hearing for the verification of all the applications for export of Crushed Milled Ceramic and Catalytic Converter waste out of India.
- After the verification is done, MoEF and SPCB will issue a consent letter for the exportation of scraps like Crushed Milled Ceramic and Catalytic Converter waste out of India.
- A legally binding agreement will be drafted between the two countries as they are initiating the recycling purposes of scrap materials like Crushed Milled Ceramic and Catalytic Converter waste. Also, there should be a clause in the agreement that says, both of the parties, i.e. the countries do not have any problem regarding the importation and exportation of the scraps like Crushed Milled Ceramic and Catalytic Converter waste.
- The authority will draft a post compliance report and send it to the applicant.
- Now the Ministry of Environment and Forest will notify the SPCB regarding the compliance report and will ask the authority to go through the procedure at the applicant’s end. They will need to draft a report regarding whether every piece of error mentioned in the compliance report has been corrected.
- After all the above mentioned steps are fulfilled, MoEF or SPCB will issue a permission letter to the applicant to initiate the procedure of exportation of scraps like Crushed Milled Ceramic and Catalytic Converter waste out of India.
Rules for the exporter:
The exporter needs to follow certain basic rules. The exporter needs to make sure that below mentioned points will not be violated as per stated in the Customs Act, 1962.
- The exported scraps like Crushed Milled Ceramic and Catalytic Converter waste will be used only for recovery and recycling purposes.
- Exportation of scraps like Crushed Milled Ceramic and Catalytic Converter waste is not permitted just for the purpose of disposal.
- No municipal solid waste, post consumer domestic waste, Bio-chemical waste, or any type of hazardous waste should be exported to any country along with the plastic scraps mentioned in the papers. If such instances occur, the exporter needs to bring back all the waste bearing the transportation charges in the case of violation of the rules.
- The agency must have all the details of the exporter, from where the exportation takes place, and also maintain an inventory mentioning all scraps such as Crushed Milled Ceramic and Catalytic Converter waste.
- If any sort of residue occurs during the recycling process, the agency needs to maintain a tab mentioning the nature and quantity of the residue. Also, the agency needs to dispose of the residue, maintaining the ecologically safe procedure mentioned in the proforma of the concerned Pollution Control Board.
Validity of the consent letter:
The MoEF will release a NOC or No Objection Certificate and the SPCB will release a consent letter. The NOC is valid till the Consent Letter is valid.
