- Clause 1: In the event of having a liaison or branch office of the foreign producer in India, then the latter shall be the AIR.
- Clause 2: Where there is no such office but there is the proprietor or the registered user of the product brand/trademark in India, then the latter shall be the AIR.
- Clause 3: Where the above two are not possible, then any other Indian organization can be appointed as the AIR, subject to the condition that it should be an Indian company registered in India.
Process For Indian Manufacturers
The process is easier for Indian (domestic) manufacturers as they don't need to appoint an Authorized Indian Representative. The process is the following:
- Initiate online filing of the application.
- Submit product samples tested at a BIS-approved laboratory for conformity to IS 13252 (Part 1): 2010.
- Submit online/offline the test report and application.
- The application and supporting documents are inspected and verified by BIS officers.
- The licence is issued after verifying that the application has been filed properly.
